Terms and Conditions
These Terms and Conditions (the “Terms”) govern your access to and use of traveladoffers.com, any partner-branded TravelAd Offers page, and the search, wishlist, offer-request, booking-referral and support features we provide through them (together, the “Platform”). By using the Platform, submitting your details or making a Booking you agree to these Terms. If you do not agree, do not use the Platform.
1. Definitions
- “Experience” means a tour, activity, attraction ticket, transfer, dining reservation or other travel or lifestyle service displayed on the Platform.
- “Offer” means a discount, voucher code, promotional rate, gift or other benefit displayed on the Platform that is provided and honoured by a Supplier or Third-Party Provider, whether or not it involves a Booking.
- “Supplier” means the independent business that delivers an Experience or honours an Offer. The Supplier is identified on the Experience or Offer page and in your confirmation.
- “Third-Party Provider” (or “Provider”) means the independent marketplace, booking platform, distributor, aggregator or other business through which Experiences and Offers are made available on the Platform and which handles bookings, payments, confirmations, cancellations, refunds and customer service for them.
- “Provider Terms” means the customer terms and conditions, cancellation policy and privacy notice of the relevant Third-Party Provider and Supplier, as shown or linked on the Experience or Offer page and at checkout.
- “Booking” means a reservation of an Experience or redemption of an Offer initiated through the Platform; “Confirmation” means the email or message from the Third-Party Provider or Supplier confirming it and containing your voucher, code or reference.
- “Partner Instance” means a version of the Platform published under the brand of a mobile network operator, loyalty programme or other partner of Sibia.
- “Consumer” means a natural person acting for purposes outside their trade, business, craft or profession.
2. Our role
2.1 We aggregate and display Experiences and Offers made available by Third-Party Providers and Suppliers, and we let you search, save, request and initiate them.
2.2 When you make a Booking, a contract for the Experience or Offer is formed between you and the Supplier. The Third-Party Provider acts as the Supplier’s disclosed agent (or, where its Provider Terms so provide, as the seller) for booking, payment collection, confirmation, amendments, cancellations, refunds and customer service. The Provider Terms govern all of those matters. We show you or link to the Provider Terms before you commit to a Booking, and you accept them when you proceed.
2.3 These Terms govern your use of the Platform and your relationship with Sibia. The Provider Terms govern the Experience or Offer itself and your relationship with the Third-Party Provider and Supplier. If they conflict on a matter concerning the Experience or Offer (including price, delivery, cancellation, change or refund), the Provider Terms prevail.
2.4 Descriptions, images, inclusions, exclusions, durations, meeting points, prices, availability, ratings and reviews are supplied by Third-Party Providers and Suppliers through automated feeds. We display them in good faith and correct errors when we become aware of them, but we do not independently verify them and cannot guarantee their accuracy or completeness. Supplier names, addresses and contact details are those the Supplier has registered with the Third-Party Provider.
2.5 A Partner Instance is provided by Sibia. The partner whose brand appears on it does not sell Experiences or Offers and is not a party to your Booking unless the Partner Instance expressly states otherwise.
2.6 Some Experiences and Offers are shown in featured positions or marked as sponsored because a Third-Party Provider, Supplier or advertiser has paid for that placement. Such placements are labelled “Sponsored” or “Featured”. Search results otherwise rank by relevance, popularity and availability as reported by the Third-Party Provider.
3. Using the Platform
3.1 You must be at least 18 years old and have legal capacity to make a Booking or submit your details. By doing so you confirm that you are authorised to accept these Terms on behalf of every member of your party, including any minors, and that you will inform them of these Terms and the Provider Terms.
3.2 You agree to use the Platform only for lawful, personal and non-commercial purposes; to give accurate, complete and current information; and not to scrape, copy, reverse-engineer, overload or interfere with the Platform, its content or its security, or to use it to send unsolicited messages, malware or unlawful content.
3.3 “My Wishlist”, offer requests and other features are provided as a convenience. Saving an Experience or requesting an Offer does not reserve it, hold its price or guarantee its availability.
3.4 We may suspend or terminate your access to the Platform, and ask the Third-Party Provider to cancel any Booking obtained through fraud, misuse or breach of these Terms, subject to your rights under applicable law.
4. Prices, discounts and availability
4.1 Prices are set by Suppliers and Third-Party Providers, not by Sibia. They are shown per person, per group or per unit as stated and does not include applicable taxes and fees unless the page states that. Prices may change until your Booking is confirmed by the Third-Party Provider; the price in your Confirmation is the price you pay.
4.2 If you pay in a currency other than the display currency, your card issuer’s or the Third-Party Provider’s exchange rate and any foreign transaction fees apply.
4.3 If an Experience or Offer is displayed at an obviously incorrect price or with incorrect information because of a technical, feed or data error, the Third-Party Provider or Supplier may decline or cancel the Booking and refund any amount paid in full, and we will tell you as soon as we become aware. This does not limit your statutory rights.
4.4 Availability is provided by Third-Party Providers in real time or near real time. A Booking is confirmed only when you receive a Confirmation from the Third-Party Provider or Supplier. Some Experiences are subject to the Supplier’s acceptance (“on request”); the page will say so and the Provider Terms state the period within which you will be confirmed or refunded.
5. Submitting your details and making a Booking
5.1 To receive an Offer, request availability or make a Booking you will be asked for the name, email address, telephone number, country of residence and any details the Supplier requires (such as traveller numbers, ages, pickup location or language). You submit these details to Sibia, which records them and passes the details needed for the Booking to the Third-Party Provider and Supplier. Sibia’s use of your details is described in our Privacy Policy and section 11 below.
5.2 You select the Experience or Offer, date, time and number of travellers, provide the details above, review the price, the Supplier’s cancellation policy and the Provider Terms, accept these Terms and the Provider Terms, and complete payment (where payment is required) in the manner described in section 6. Depending on the Third-Party Provider, the final steps may take place on the Platform or on the Third-Party Provider’s own pages.
5.3 You are responsible for the accuracy of the details you give. The Third-Party Provider or Supplier will send the Confirmation to the email address (and, where you have opted in, the telephone number) you provide. Keep it and present the voucher or code as instructed.
5.4 Some Offers are delivered as a code, link or voucher sent to you after you submit your details. Redemption is subject to the Supplier’s or Third-Party Provider’s conditions shown with the Offer (validity period, minimum spend, exclusions).
6. Payment
6.1 Payment for a Booking is collected by the Third-Party Provider (or the Supplier) as merchant of record, in one of the following ways, which will be clear to you at checkout: (a) you are redirected to the Third-Party Provider’s own secure checkout; (b) you pay through a payment component embedded in the Platform that is operated by the Third-Party Provider or its payment service provider; or (c) where a Third-Party Provider has appointed Sibia for that purpose, Sibia collects the payment through its payment service provider solely as limited payment collection agent for the Third-Party Provider and Supplier and remits it to them.
6.2 Where section 7.1(c) applies: payment to Sibia discharges your payment obligation to the Supplier for the amount paid; Sibia holds the funds for the Third-Party Provider and Supplier and is not the seller of the Experience; Sibia’s responsibility in respect of the payment is limited to remitting it to the Third-Party Provider or Supplier and, where a refund is authorised under the Provider Terms, returning the funds it holds in accordance with section 7.4.
6.3 Sibia does not collect or store full payment card details. Card data is entered directly into the secure form of the payment service provider or Third-Party Provider, which is PCI DSS-compliant, and Sibia receives only a confirmation, the card type and the last four digits.
6.4 We, the Third-Party Provider and the payment service provider may carry out fraud, sanctions and security checks, ask you to verify your identity or payment method, and decline or cancel a Booking that fails those checks, refunding any amount charged. We are not liable for a Booking declined on these grounds.
6.5 If you reverse a payment through your card issuer without a valid basis under these Terms or the Provider Terms, the Supplier may cancel the Booking and the Third-Party Provider or Sibia may recover the amount and reasonable costs from you.
6.6 We are not responsible for failures, delays or errors of payment service providers, card networks or banks, or for exchange-rate differences and bank fees, except to the extent caused by our negligence.
7. Cancellations, changes and refunds
7.1 The cancellation, amendment and refund policy that applies to your Booking is the one set by the Supplier and the Third-Party Provider and shown to you on the Experience page and in the checkout summary before you commit which always prevails over any general description on the Platform.
7.2 Your ability to cancel is governed by the Third-Party Provider cancellation policy. Where an Offer is an open-dated voucher to which a withdrawal right does apply, the Provider Terms will say so and explain how to exercise it.
7.3 A Supplier may cancel or change an Experience for reasons of safety, severe weather, sea or road conditions, force majeure, government action, or because a minimum number of participants was not reached. Your remedy is set out in the Provider Terms and is provided by the Third-Party Provider or Supplier.
7.4 Refunds are authorised and paid by the Third-Party Provider or Supplier under the Provider Terms, to the original payment method, in the currency charged. Where Sibia collected payment as collection agent (section 7.1(c)) and still holds the funds, Sibia will return the refunded amount within 5 business days of the Third-Party Provider’s authorisation; where Sibia has already remitted the funds, the Third-Party Provider or Supplier pays the refund. Banks and card issuers may take a further 5 to 10 business days to show a refund. Sibia does not charge cancellation or refund fees and is not responsible for exchange-rate differences or bank charges.
7.5 Cancellation Policies apply regardless of the reason for cancellation, including illness, flight delays or visa refusal. We strongly recommend that you hold travel insurance covering cancellation, medical expenses and personal accident for the activities you book.
8. Reviews and content you submit
Reviews and ratings on the Platform are supplied by Third-Party Providers from travellers who booked through them; we do not verify them and they do not represent our views. If the Platform allows you to submit reviews, photos or other content, you grant Sibia and the relevant Third-Party Provider a worldwide, royalty-free, non-exclusive licence to use, reproduce, display and distribute it in connection with the Platform, and you confirm that it is truthful, your own and not unlawful, defamatory or infringing. We may remove content at our discretion.
9. Intellectual property
The Platform, the TravelAd and TravelAd Offers names and logos, and our software and design are owned by Sibia or its licensors. Experience and Offer descriptions, images and reviews are owned by the Third-Party Providers, Suppliers or their licensors and are displayed under licence. You may view, download and print content for personal, non-commercial use in connection with a Booking. Any other use, including scraping or republishing, is prohibited without our written permission.
10. Availability of the Platform
10.1 We aim to keep the Platform available but do not guarantee uninterrupted or error-free operation, and Third-Party Provider feeds may be unavailable from time to time. We may modify, suspend or withdraw any part of the Platform, or any Third-Party Provider’s inventory, for maintenance, security or commercial reasons. Bookings already confirmed by a Third-Party Provider are not affected.
10.2 Sibia is not liable for the acts, omissions, negligence or insolvency of any Supplier or Third-Party Provider, for the quality, safety, legality, availability, price or description of any Experience or Offer, for a Supplier’s refusal to honour an Offer, or for any cancellation, change or refund, except to the extent the law applicable to you provides otherwise. Claims relating to an Experience or Offer must be addressed to the Third-Party Provider or Supplier under the Provider Terms.
11. Personal data
11.1 Sibia is the controller of the personal data you enter on the Platform (including offer requests, booking forms, wishlist and support conversations) and processes it in accordance with our Privacy Policy and Cookie Policy.
11.2 When you submit your details or make a Booking, we pass the details required for the Experience or Offer to the relevant Third-Party Provider and Supplier, who process them as independent controllers under their own privacy notices linked on the page and at checkout.
11.3 Where you have given your consent, we will use your contact details to send you information about experiences, offers and destinations from Sibia and its Partner Instances. You can withdraw that consent at any time using the link in any message or by contacting us.
12. Third-party links and services
The Platform links to and embeds websites and services operated by Third-Party Providers, Suppliers, partners whose brands appear on Partner Instances, payment providers and others. We are not responsible for their content, terms or practices. Your use of them is at your own risk and subject to their terms.
13. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in law, in Third-Party Providers or their terms, or in the Platform. The version in force when you make a Booking applies to that Booking. We will post the updated Terms with a new “Last updated” date and, for material changes, give notice on the Platform. Continued use of the Platform after an update constitutes acceptance of the changes for future use.
14. Governing law and jurisdiction
14.1 These Terms, and any dispute or claim arising out of or in connection with them or your use of the Platform, are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, and the courts of Dubai have jurisdiction.
14.2 Your contract with the Supplier for the Experience or Offer is governed by the Provider Terms and any law they specify.
15. General
These Terms, the Privacy Policy, the Cookie Policy and the Experience or Offer page are the entire agreement between you and Sibia regarding the Platform. Your contract for the Experience or Offer is separately constituted by the Provider Terms and your Confirmation.
If any provision is held invalid, the rest remains in force and the invalid provision is replaced by a valid one that most closely reflects its intent.
A delay in enforcing a right is not a waiver of it.
You may not transfer your rights under these Terms without our consent. We may transfer our rights to a successor of our business; your rights are not reduced.
These Terms are drafted in English. Translations are provided for convenience; the English version prevails to the extent permitted by law.
Neither Sibia, the Third-Party Provider nor the Supplier is liable for failure or delay caused by events beyond reasonable control, including natural disasters, extreme weather, epidemics, strikes, government action, war, terrorism, or failure of telecommunications or third-party systems.
